OVERVIEW
Welcome to STATIC.
The terms “STATIC,” “we,” “us,” and “our” refer to STATIC. STATIC operates this online store and website, including the information, content, features, tools, products, and services made available through the website (collectively, the “Services”).
Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies referenced herein, describe your rights and responsibilities when accessing or using the Services.
Please read these Terms of Service carefully. They contain important information about your legal rights, responsibilities, limitations of liability, and other matters relating to your use of the Services.
By visiting, accessing, interacting with, or purchasing from our Services, you agree to be bound by these Terms of Service and the policies incorporated into them.
If you do not agree with these Terms of Service, you should not access or use the Services.
SECTION 1 - ACCESS AND ACCOUNTS
By using the Services, you represent that you have the legal capacity to enter into an agreement under the laws applicable to you or that you are using the Services with the permission and supervision of a parent or legal guardian where required.
To browse our store, create an account, place an order, or use certain features of the Services, you may be asked to provide information including your name, email address, billing information, payment information, contact information, and shipping address.
You agree that all information you provide is accurate, current, and complete and that you have the right to provide that information.
You are responsible for maintaining the confidentiality and security of any account credentials associated with the Services and for activity conducted through your account.
You may not transfer, sell, assign, or license your account to another person without our written permission.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to display and describe our products accurately.
However, colours and product appearance may vary depending on:
- the device or screen used to view the product;
- display settings and calibration;
- lighting conditions;
- photography and image processing;
- fabric characteristics;
- garment washing or finishing treatments; and
- normal manufacturing variation.
Certain STATIC garments intentionally feature characteristics such as vintage washing, enzyme washing, snow washing, sun fading, distressing, fraying, paint splatter effects, print variation, and other finishing treatments.
These characteristics may create natural variation between individual garments and are part of the intended design unless the variation constitutes an actual manufacturing defect.
Product descriptions, specifications, pricing, availability, and other product information may be updated or corrected when reasonably necessary.
We reserve the right to discontinue products, limit quantities, or restrict the sale of products to particular people, geographic areas, or jurisdictions where reasonably necessary or legally required.
Nothing in this section limits any rights that cannot lawfully be excluded under applicable consumer protection laws.
SECTION 3 - ORDERS
Submitting an order is an offer to purchase products from STATIC.
An order is subject to acceptance and availability. We reserve the right to decline or cancel an order where reasonably necessary, including in circumstances involving:
- suspected fraud or unauthorized payment activity;
- incorrect pricing or product information;
- product unavailability;
- technical or inventory errors;
- suspected commercial resale;
- violation of these Terms; or
- circumstances in which fulfilling the order would be unlawful.
Payment must be successfully authorized and processed before an order can proceed.
Please review your order carefully before submitting it.
Many STATIC products are produced specifically for each order and may enter production shortly after an order is placed. As a result, cancellation or modification requests cannot be guaranteed once production has started.
If we cancel an order after payment has been successfully processed, we will issue any applicable refund to the original payment method.
Returns and refunds are governed by our Return & Refund Policy.
Customers are responsible for reviewing product selections, sizes, colours, quantities, and shipping information before completing checkout.
SECTION 4 - PRICES, PAYMENT, AND BILLING
Prices, discounts, product availability, and promotions may change without notice.
The price charged for a product will generally be the price displayed at the time the order is placed, subject to correction of obvious pricing errors and applicable law.
Unless expressly stated otherwise, product prices may not include:
- shipping charges;
- applicable sales taxes;
- customs duties;
- import taxes;
- brokerage charges; or
- other destination-specific charges.
Where applicable, these amounts may be calculated at checkout or charged separately by the appropriate carrier, customs authority, government agency, or service provider.
You agree to provide accurate and current billing, payment, account, and contact information.
You represent that you are authorized to use the payment method submitted for an order.
We reserve the right to correct genuine pricing or billing errors, subject to applicable law.
SECTION 5 - SHIPPING AND DELIVERY
Shipping and delivery are governed by our Shipping Policy.
Many STATIC products require production before shipment. Production time and shipping transit time are separate stages of the order process.
All delivery timelines and estimated delivery dates are estimates only unless expressly stated otherwise.
Delivery times may be affected by circumstances including:
- production requirements;
- product availability;
- fulfillment location;
- carrier operations;
- customs processing;
- weather events;
- transportation disruptions;
- holidays and peak periods;
- labour disruptions;
- incorrect or incomplete shipping information; and
- other circumstances outside our reasonable control.
If an order is significantly delayed, appears lost in transit, arrives damaged, or is marked delivered but cannot be located, contact us at staticsignalshop@gmail.com.
We will review the available information and assist in accordance with our Shipping Policy.
Nothing in this section limits rights or remedies available under applicable law.
SECTION 6 - RETURNS, REFUNDS, AND DEFECTIVE PRODUCTS
Returns and refunds are governed by our Return & Refund Policy.
Eligible standard returns may be requested within the return period stated in that policy and must meet the applicable return conditions.
Items that arrive damaged, defective, misprinted, or incorrect are handled separately from standard change-of-mind, fit, or sizing returns.
Customers should report damaged, defective, misprinted, or incorrect merchandise promptly and within the reporting period stated in our Return & Refund Policy.
We may request:
- the order number;
- a description of the issue;
- photographs of the complete item;
- photographs showing the affected area; and
- photographs of packaging where shipping damage is involved.
Do not return merchandise without first contacting STATIC and receiving return instructions.
Nothing in our Return & Refund Policy or these Terms limits any non-waivable rights or remedies available under applicable consumer protection law.
SECTION 7 - INTELLECTUAL PROPERTY
The Services and their content may include trademarks, trade names, logos, artwork, graphics, photographs, videos, text, designs, product imagery, collection names, creative concepts, website elements, and other materials owned by or licensed to STATIC.
These materials are protected by applicable intellectual property laws.
You may access and use the Services for personal, lawful, non-commercial purposes.
Unless expressly authorized by STATIC in writing, you may not:
- reproduce or republish our content;
- distribute or commercially exploit our content;
- create unauthorized derivative works;
- use STATIC artwork or graphics on merchandise or products;
- copy or reproduce product photography for commercial use;
- use STATIC names, logos, graphics, or branding in a way that suggests endorsement or affiliation; or
- remove or alter intellectual property notices.
No right, title, license, or interest in STATIC intellectual property is transferred to you through your use of the Services or purchase of a product.
All rights not expressly granted are reserved.
Shopify’s names, trademarks, logos, and services remain the property of Shopify or its licensors.
Other trademarks displayed through the Services belong to their respective owners.
SECTION 8 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The Services may provide access to tools, applications, integrations, payment services, social platforms, shipping services, or other services operated by third parties.
We do not control all third-party services and cannot guarantee their continued availability, accuracy, or performance.
Your use of a third-party service may be governed by that provider’s own terms and privacy practices.
We are not responsible for third-party services except to the extent required by applicable law.
We may introduce new tools, integrations, features, or resources in the future. Unless otherwise stated, those features form part of the Services and are subject to these Terms.

The Services may contain links to third-party websites, platforms, applications, or services.
We are not responsible for the content, accuracy, availability, security, policies, or practices of websites and services that we do not control.
Accessing a third-party website or service is at your discretion.
Before entering into a transaction with a third party, review that party’s terms, policies, and practices.
Questions or complaints regarding third-party products or services should generally be directed to the relevant third party.
SECTION 10 - RELATIONSHIP WITH SHOPIFY
STATIC is powered by Shopify, which enables us to provide the Services to you.
However, sales and purchases made through our store are transactions directly between you and STATIC.
By using the Services, you acknowledge that Shopify is not the seller of STATIC products and is not responsible for the performance of STATIC’s obligations to customers.
To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages, liabilities, losses, or disputes arising solely from transactions between you and STATIC.
Nothing in this section limits rights that cannot legally be limited or excluded.
SECTION 11 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted on Shopify, Shopify may collect and process personal information relating to access to and use of the Services in connection with providing and improving its services.
Information may also be processed by third-party providers involved in areas such as:

- fraud prevention;

This does not transfer ownership of your original content to STATIC.
You agree that submitted content will not:
- infringe intellectual property rights;
- violate privacy or publicity rights;
- contain unlawful or defamatory material;
- contain malicious code;
- intentionally mislead other users; or
- falsely represent your identity or experience.
We may moderate, refuse, or remove submitted content where reasonably necessary.
We are not obligated to compensate you for unsolicited feedback unless otherwise agreed in writing.

Nothing in this section prohibits legitimate product discovery, indexing, or commerce interactions specifically authorized through Shopify, STATIC, or approved sales channels.

We may suspend or terminate access to the Services where reasonably necessary, including for:
- violation of these Terms;
- suspected fraud;
- unlawful conduct;
- security risks;
- misuse of the Services; or
- circumstances in which continued access may harm STATIC, customers, Shopify, or third parties.
Termination does not eliminate obligations or liabilities that arose before termination.
Provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, liability, indemnification, privacy, governing law, and accrued payment obligations.
SECTION 17 - DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
We do not guarantee that the website or Services will always be uninterrupted, error-free, secure, or available at all times.
Information available through the Services is provided for general informational and ecommerce purposes.
Except where expressly stated or required by law, STATIC makes no additional representation or warranty beyond those rights and warranties that cannot legally be excluded.
Some jurisdictions do not permit the exclusion of certain warranties or conditions. In those jurisdictions, exclusions apply only to the extent legally permitted.
SECTION 18 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, STATIC and its affiliates, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the use of the Services.
This may include, where legally permitted, loss of profits, revenue, savings, data, opportunity, or similar losses.
Nothing in these Terms excludes or limits liability where liability cannot legally be excluded or limited, including any rights and remedies that may be available under applicable consumer protection law.
The limitations in this section apply only to the fullest extent permitted by law.
SECTION 19 - INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless STATIC and its affiliates, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, losses, damages, and reasonable legal costs arising from:
- your material breach of these Terms;
- your unlawful use of the Services;
- your violation of applicable law; or
- your infringement of the rights of another person or entity.
This section does not apply to the extent a claim results from STATIC’s own unlawful conduct or where indemnification is prohibited by law.
SECTION 20 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed where necessary.
The remaining provisions will continue in effect.
SECTION 21 - WAIVER AND ENTIRE AGREEMENT
Our failure to immediately exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and other policies expressly incorporated into them, form the agreement governing your use of the Services.
Nothing in this section limits rights that cannot legally be waived.
SECTION 22 - ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent where consent is legally required.
STATIC may assign or transfer its rights and obligations in connection with a legitimate restructuring, sale, transfer, merger, or other business transaction, subject to applicable law.
SECTION 23 - GOVERNING LAW
These Terms of Service and any separate agreements through which STATIC provides Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada.
Subject to any rights, remedies, or jurisdictional protections available under applicable consumer protection law, disputes relating to these Terms or the Services will be subject to the jurisdiction of the courts of British Columbia.
Nothing in these Terms limits any legal rights that cannot lawfully be waived or excluded.
SECTION 24 - CHANGES TO THESE TERMS
The current version of these Terms of Service will be available through our website.
We may update these Terms from time to time to reflect changes to:
- our Services;
- our products;
- store operations;
- technology;
- legal or regulatory requirements; or
